These terms are an agreement between you and Miranda Network SL, Tenerife, Spain covering your use of Aeris. By downloading or using the app, you accept them.
They are written to be read. Where something limits what you can expect from the app, it is said plainly rather than buried.
What Aeris does
Aeris helps you stop vaping by keeping count. It tracks how long it has been since you quit, records the cravings you log and what set them off, estimates the money you have not spent, and marks the health milestones that generally follow stopping nicotine. It runs entirely on your phone.
Aeris is not medical treatment
This is the most important clause in this document, so it is not buried. Aeris is a motivational and tracking tool. It is not a medical device, it makes no diagnosis, it provides no treatment, and it is not a substitute for advice from a doctor, a pharmacist or a stop-smoking service.
Nicotine dependence is a real physical dependence, and withdrawal can affect your mood, your sleep and your concentration, and can interact with medication and with existing conditions. Talk to a healthcare professional before or while you quit — particularly if you are pregnant, taking prescribed medication, or managing a mental or physical health condition. Most countries have a free stop-smoking service, and it is better than any app, including this one.
If you feel unwell, or your mental health deteriorates while quitting, seek medical help. Do not wait for a milestone in an app.
Health milestones are general information
The recovery timeline Aeris shows is drawn from general public-health information about what typically happens after people stop using nicotine. It is a population average, not a measurement of you and not a prediction about you.
- Aeris measures nothing about your body. It knows only the date you gave it and how much time has passed.
- Your own recovery depends on how long and how heavily you used nicotine, your health, and much else the app cannot see.
- Reaching a milestone in the app is not a clinical finding and says nothing about your actual state of health.
The numbers come from what you told it
Money saved, nicotine avoided and similar figures are arithmetic on the amounts and prices you entered at setup. If those were rough, the totals are rough. They are there for encouragement, not accuracy, and we do not warrant that any of them is correct.
Relapsing is not a breach of these terms
Worth saying, since everything else here is written in the language of obligations: nothing in this agreement asks you to succeed. Resetting a streak, logging a relapse or putting the app down for a month costs you nothing but the streak. Most people who stop for good do it after several attempts.
Subscriptions and billing
Full use of Aeris requires an active subscription. Subscriptions are sold through the App Store, billed by Apple to your Apple Account, and governed by Apple's terms as well as these.
- Where a free trial is offered, it converts into a paid subscription at the end of the trial period unless you cancel first.
- Subscriptions renew automatically for the same period, at the price shown at purchase, unless cancelled at least 24 hours before the current period ends.
- You are charged within 24 hours of the end of the current period.
- Manage or cancel at any time in Settings → your name → Subscriptions on your device. Deleting the app does not cancel a subscription.
- Cancelling stops the next renewal; the current period runs to its end and is not refunded pro rata.
Refunds are handled by Apple, not by us, at reportaproblem.apple.com. If something went wrong on our side, write to us and we will help you sort it out with Apple.
If you are a consumer in the EU, you have a 14-day right of withdrawal for digital purchases. That right is exercised through Apple as the seller.
Your data lives on your device
Aeris keeps your history on your phone, not on our servers. That is a deliberate choice, and it has a consequence worth understanding before you build up months of progress: if you lose the phone, replace it, or delete the app, that history is gone. We cannot restore it, not as a matter of policy but because we never held a copy. Your subscription itself survives — reinstall and use Restore Purchases.
Your content is yours
Everything you record belongs to you. We claim no ownership of it and no licence to use it, we do not train anything on it, and we could not sell it if we wanted to, because it never reaches us.
Availability
Aeris works offline; the only thing that needs a connection is buying or restoring a subscription, which depends on Apple's systems and RevenueCat's rather than on ours. We may change or discontinue features, and will not remove something material from a paid subscription without notice.
Fair use
A subscription is for your personal use on your own devices. Sharing a subscription, reselling access, or attempting to circumvent the purchase check is not permitted.
Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law — including your statutory rights as a consumer, which these terms do not affect.
Subject to that, and to the fullest extent the law allows, our total liability arising out of your use of Aeris is limited to the amount you paid us for it in the twelve months before the claim. We are not liable for health outcomes, for decisions you took instead of seeking medical advice, for indirect or consequential loss, or for lost records where you kept no backup of your own.
Ending this agreement
You may stop at any time by cancelling your subscription and deleting the app. We may end your access if these terms are seriously or repeatedly breached.
Changes to these terms
We may update these terms. The date at the top always reflects the current version, and material changes will be announced in the app before they take effect. Continuing to use Aeris after that means you accept the new terms; if you do not, cancel and delete the app.
Governing law
These terms are governed by Spanish law. If you are a consumer, you keep the protection of the mandatory rules of the country you live in, and you may bring proceedings in your local courts. Consumers in the EU may also use the European Commission's online dispute resolution platform.
